The Buyer declares to accept the general terms and conditions of sale in effect at the time of sending the purchase order. Teamecommerce s.r.l. reserves the right to modify the sales conditions published on this website at any time, without prior notice to users. These changes will apply only to orders placed after the date of publication.

The purchase of products through the website is allowed both to Buyers who qualify as Consumers according to art. 3, paragraph 1 lett. A of the Consumer Code, and to those who do not have this qualification. In order to place orders on this website, the Buyer must be of legal age (18 years).

Features of Easy Life products

The majority of Easy Life products are crafted by hand. Airbrush coloring, decal decoration, baking in different batches result in slight chromatic and shape differences, light imperfections that are the distinctive sign of this craftsmanship that is thus highlighted. We invite every customer to read the section dedicated to craftsmanship – wonderful but not perfect products before making a purchase to discover what cases could occur. These characteristics will not be considered conformity defects and will not entitle to replacement or contract resolution.

That being said, it is important to emphasize that our pieces are not identical to each other, but the small differences are natural, inherent, and represent the uniqueness of each item.

Buying a handmade product should be a conscious purchase. It means choosing items mostly made by hand, opting for non-industrial and non-mass-produced products, and purchasing a product that is unique.

It is precisely the uniqueness, originality, and attention to detail that make each handmade product different from the others.

The manufacturing of some collections of Easy Life (Abitare, Artesanal, Design Art, Interiors, Colours Splash) has been done using artisanal processes, which is why you will hardly find two identical products. Furthermore, what an untrained eye might consider as “small imperfections” are actually a testimony of craftsmanship and quality.

These imperfections can include: black dots, surface imperfections, decal overlaps, imprecision in decal placement, color differences in decals, roughness on the back parts, small irregularities on contact parts, even color differences between similar products in reactive finishes, color concentration in natural deposit areas, color differences in wood components, rear glue points, signs of junction between different elements or handles, variations in weights, variations in dimensions. This all happens because human craftsmanship is involved in the production of most Easy Life products. Airbrush coloring, decoration with decals, oven baking in different batches inevitably generate some of the aforementioned characteristics. These are intrinsic features of our product that help give style to the creation and make it recognizable among many others.

The images published on the website reproduce the products as faithfully as possible. However, these images should be considered purely indicative, as there may be differences due to the technical characteristics of the screens on which the products are displayed.

Products are sold with the features published on the website and at the indicated price. The Seller reserves the right to modify the product price at any time, which will be applied only to subsequent orders.

Purchase Methods

Products on the website can be purchased by adding them to a virtual shopping cart.

To complete the order, the Buyer must finalize the order on the website following the instructions that will appear progressively on the screens during the purchase procedure. Before transmitting the order, the Buyer can view the cart and eventually modify the quantity of products added, view the total price resulting from the sum of the products, and at the same time, get an initial estimate of shipping costs and delivery times. In this initial screen, it will also be possible to enter coupon codes to apply additional discounts to the cart.

Subsequently, a screen will be opened where the Buyer can enter their details to finalize the order (such as personal data, billing and shipping information, email address, and phone number), as well as view the final shipping costs based on the entered address and choose the desired payment method.

In order to transmit the order, the Buyer must necessarily indicate, through a checkbox, that they declare to have read the privacy policy and authorize the processing of personal data to proceed with the purchase, to have read and accepted the “General conditions of sale” and to have read and accepted what is written on the “Craftsmanship” page. The Buyer is therefore invited to carefully read this information before accepting.

Once the order has been transmitted, the Buyer will receive, at the email address provided during the purchase, the order confirmation containing a summary of the products, shipping details, and payment information.

Upon receiving the order confirmation email, the contract will be considered finalized.

Order details, for registered users, can also be viewed through the specific personal section of the website called “My Orders.”

Ordered products and order-related data can be modified upon specific request to the email address info@teamecommerce.com, provided that the request is made before the shipment of the package.

The received order, once fulfilled and after 14 days from delivery for the exercise of the right of withdrawal by the Consumer, will be archived in the Seller’s computer systems as required by law.

In the case of discounted products on the website, the product page will indicate the full price before the discount, the percentage of the discount, and the final discounted price.

Order completion is available in Italian, English, and French. A different language from Italian can be selected through the appropriate icon in the top right corner of the main screen.

The Seller reserves the right to refuse or cancel orders from Buyers with whom there is a legal dispute or who have violated the General Terms and Conditions of Sale in relation to previous orders.

The Seller has taken all technical measures to constantly update the online product catalog based on warehouse availability, however, technical errors that may cause incorrect information regarding product availability cannot be ruled out. In case of product unavailability at the time of the order, the Seller undertakes to immediately inform the Buyer and refund any amounts already paid by the Buyer at the time of order confirmation using the same payment method used for the purchase.

Payments

Payments on this website can be made through the following payment methods:

  • PayPal – PostePay
  • Credit / Debit / Prepaid Card
  • ScalaPay
  • Bank Transfer

If the Buyer chooses to pay by bank transfer, an order confirmation email will be sent containing the IBAN details for payment and the order ID code to be included in the reason for payment. The Buyer must make the transfer within 10 days of order transmission, after which the order will be canceled. The order will be shipped once the amount is credited to the Seller’s account.

If the Buyer chooses to pay by credit card/debit/prepaid card, it is informed that the payment will be entirely handled externally by Stripe (Stripe | Online payment processing platform).

Cash on delivery payment is expressly excluded.

Payments through Paypal and Scalapay will be governed by the contract conditions agreed between the Buyer and these institutions.
The Seller will proceed with the shipment of the products after receiving confirmation of successful payment made by the Buyer. In case of payment failure, the Seller will send an email to the Buyer requesting payment of the amount due within 10 days of receiving the email, also offering alternative payment methods, informing the Buyer that failure to pay within the specified period will result in the contract being terminated according to the law and the order canceled.

In case of delayed payment, delivery times may be affected.

Taxes and Duties

Prices displayed on the website include VAT and indirect taxes, but do not include shipping costs, which are calculated before order confirmation.

For orders to be delivered outside national borders, the Buyer is responsible for paying all customs duties, taxes, extra costs, and customs charges required by law in the destination territory. Therefore, the Buyer is advised to inquire with relevant authorities to learn about any additional taxes applicable in the destination country, specifying that lack of knowledge of these extra costs cannot be grounds for contract resolution.

Shipping and Delivery

Information on availability and delivery times provided at the time of order conclusion are indicative and not binding for the seller.

Shipping costs vary based on the package’s weight and destination. The amount is visible during the order confirmation after entering the shipping address.

In Italy, shipping costs are €9.90, while orders over €59 receive free shipping.

The Seller ships worldwide, using national and international couriers that may vary according to needs.

If the destination country is not listed for delivery, the user is urged to contact customer support through the website contacts.

For deliveries in Italy, package preparation and delivery time is between 10 and 15 working days.

Shipments to the rest of the world take around 7 days for package preparation; the remaining delivery times depend on the courier handling the order.

During holidays or promotional periods, delivery times may experience delays.

The Seller commits to respecting the indicated delivery times and, in any case, to complete delivery within a maximum of 30 days from the contract conclusion date.

If the Buyer is a Consumer as per Article 3, paragraph 1, letter A of the Consumer Code, the Buyer grants the Seller an additional delivery period if the products have not been delivered within the initial 30 days mentioned. In case of failure to deliver within the granted additional period, the Consumer has the right to terminate the contract under Article 61 of the Consumer Code. The Consumer is not obliged to grant an additional period if the Seller has explicitly refused to deliver the products, or if timely delivery is essential based on the circumstances surrounding the contract, or if the Consumer has informed the professional before contract conclusion that delivery by or on a specific date is essential. In all these cases, the Consumer can terminate the contract. Upon termination, the Seller will provide a full refund of any amount previously paid by the Consumer.

The risk of loss or damage to the products, for reasons not attributable to the Seller, is transferred to the Consumer only at the moment in which the latter, or a third party appointed by him and different from the carrier, physically takes possession of the goods.

The Seller shall not be liable for delays that are not foreseeable or not attributable to him.

At the time of shipment, the Seller will send an email to the Buyer indicating the delivery of the package to the carrier, the carrier’s details, and the tracking number to monitor the shipment’s status.

If a refund of shipping costs is required for a product within an order containing multiple products, the refunded amount will be proportional to the cost of each product.

Right of withdrawal

In the event that the Buyer qualifies as a Consumer under art. 3 paragraph 1 lett. A of the Consumer Code, he has the right to withdraw from this contract, even without stating reasons, within 14 (fourteen) days from the delivery of the products.

In order to exercise the right of withdrawal, the Consumer shall be required to send a written request to the Seller by sending an email to info@teamecommerce.com, or by registered mail with return receipt requested to the following address:

Following the communication mentioned above, the Consumer will receive a confirmation email of the right of withdrawal with instructions on how to return the product, which must be done within 14 days from the aforementioned withdrawal communication. The deadline is met if the Consumer returns the goods before the expiration of the 14-day period.

The purchased product must be returned intact, free of signs of wear, and complete with all parts, otherwise the Seller will deduct an amount from the refund equal to the decrease in the value of the returned product. If the refund has already been made by the Seller, the Consumer will be informed of the amount to be refunded due to the decrease in the product’s value and the details for payment. The Consumer is therefore encouraged not to handle the product more than necessary to evaluate its characteristics, nature, and operation, securely repackaging it for transport in case of return.

The shipping costs, in addition to any taxes and duties, for the return of products will be borne solely by the Consumer, who may choose the carrier for transportation.

The withdrawal from this contract, subject to all conditions mentioned above, will result in the Seller refunding all amounts paid by the Consumer, including shipping costs, using the same payment method used by the Consumer for the initial transaction, unless a different payment method is expressly requested. Any additional expenses resulting from the choice of a different payment method will be borne by the Consumer. Additionally, no further additional costs will be refunded resulting from the Consumer’s choice of a different type of delivery than the less costly standard delivery type offered.
The refund will be made after the Seller receives the returned products or after proof of shipment of the products by the Consumer, and in any case within 14 days from the day the Consumer was informed of the Consumer’s decision to withdraw from the contract.

Legal Guarantee

In the event that the Buyer qualifies as a Consumer under Article 3, paragraph 1, letter A of the Consumer Code, they can benefit from the legal guarantee for any product non-conformity defect that occurs within two years from the date of delivery to the Consumer.

A product is considered non-conforming when it:
a) does not correspond to the contractual description, type, quantity, and quality, and does not possess the functionality, compatibility, interoperability, and other characteristics as provided by the sales contract;

  1. b) is not suitable for any particular use desired by the consumer, which has been brought to the seller’s attention no later than at the time of the conclusion of the sales contract and which the seller has accepted;
  2. c) is not provided with all the accessories, instructions, including those related to installation, provided by the sales contract.

Therefore, breakdowns, malfunctions, or damages to the product, even accidental, caused by the Consumer or resulting from non-compliant use or failure to follow the washing or maintenance instructions possibly indicated on the packaging or attached to the product, are not subject to legal guarantee.

The Consumer must report any defects or non-conformities within the legal deadline of two months from the discovery, attaching relevant photographic documentation, via email to info@teamecommerce.com

The Seller, after evaluating the defects and non-conformities of the product sold, will authorize the return of the same by the Consumer for the subsequent repair of warranted products or, if not possible, for the replacement of the product. The specific return procedures will be indicated by the Seller in a subsequent email. The Consumer is required to make the product available for the subsequent pick-up by the Seller at their own expense. Acceptance of the return of the product will not automatically imply the acknowledgment by the Seller of the reported conformity defects, as the Seller reserves the right to verify their actual existence following the return.

In case of defects or non-conformities, the Consumer will have the right to restore the product at the expense of the Seller through direct repair or replacement, or, if this is not possible or economically disproportionate, to a reduction of the product price or the termination of the contract.
The repair or replacement is carried out by the Seller at no cost, within a reasonable period of time from the moment the Consumer informs them of the conformity defect, and without inconvenience to the Consumer, taking into account the nature of the goods and the purpose for which the Consumer wanted the goods.

The Consumer is not required to pay anything for the normal use of the replaced goods in the period prior to the replacement.
In particular, the Consumer has the right to a price reduction or contract termination if:

  • The Seller has not carried out the repair or replacement; 
  • A lack of conformity is still present despite the Seller’s attempt to restore the conformity of the goods; 
  • The lack of conformity is so serious that it justifies an immediate price reduction or the resolution of the sales contract; 
  • The Seller declares or it is clearly evident from the circumstances that they will not restore the conformity of the goods within a reasonable period or without significant inconvenience to the Consumer. 

The price reduction will be proportional to the decrease in the value of the product compared to a conforming product.

The Consumer must exercise the right to terminate the sales contract by means of a direct statement to the Seller containing the intention to terminate the sales contract. 

If the lack of conformity concerns only some of the products delivered in accordance with the sales contract and there is a reason for terminating the sales contract, the Consumer can terminate the contract only with regard to non-conforming products and those purchased together with the non-conforming products, if it is not reasonably presumable that the Consumer has an interest in retaining the products free from defects.

If the Consumer entirely terminates the sales contract or, only with regard to some of the products delivered under the sales contract:

  • a) the Consumer returns the product to the seller, at the seller’s expense, and
  • b) the Seller reimburses the Consumer the price paid for the product upon receipt of the product or evidence provided by the consumer regarding the return or shipment of the product.

The Consumer does not have the right to terminate the contract if the lack of conformity is only minor. The burden of proving the minor nature of the defect lies with the Seller.

In the event of contract termination, the Seller, upon receipt of the product or evidence of shipment, will refund all sums paid by the Consumer, including shipping costs, through the same payment method used by the Consumer for the initial transaction, unless a different payment method is expressly requested.

The legal warranty does not apply in the case of non-substantial differences between the products received following the purchase and the photographs and descriptions on the website.
Furthermore, the legal warranty does not apply to defects resulting from the artisanal production process as specified in the “Characteristics of Easy Life products” paragraph.

If the Buyer is not considered a Consumer by law, the discipline referred to in articles 1490 and following of the Civil Code applies. 

Intellectual Property

All trademarks, names, graphics, designs, images, texts, patterns, and distinctive signs on the website remain the exclusive property of Pozzi Milano s.p.a.. The design and graphic interface of the website remain the property of Teamecommerce s.r.l. The purchase of products does not entail any transfer of ownership of the related intellectual property rights.
The contents on the site cannot be reproduced or used in any way without the prior written consent of Pozzi Milano s.p.a.

Privacy Protection

The Buyer, by concluding the purchase order of the products, acknowledges that their personal data is used by the Seller exclusively for the execution of the contract and related legal obligations. Any further purposes, such as marketing activities or newsletters, require a prior express optional consent that does not prevent the conclusion of the sales contract. Payment data will not be managed directly by the Seller but by third-party providers, who guarantee high security standards and the correct processing of data in accordance with the law.

Complaints and Alternative Dispute Resolution

The Seller’s operators will handle complaints as quickly as possible, guaranteeing a response within 30 days of receipt.

In the event that the Buyer qualifies as a Consumer pursuant to art. 3 paragraph 1 lett. A of the Consumer Code, they will still have the right to use the European ODR (Online Dispute Resolution) platform to attempt an out-of-court resolution of the dispute.

This platform, managed by the European Commission pursuant to Directive 2013/11/EU and EU Regulation No. 524/2013, guarantees an impartial system for resolving disputes related to contractual obligations arising from sales contracts or online services between a consumer residing in the Union and a professional established in the Union through the intervention of an authorized third-party and impartial Alternative Dispute Resolution (ADR) body.

Applicable Law and Jurisdiction.

These General Conditions and any contract concluded with the Buyer are governed by Italian law, without prejudice to the application of community regulations and international treaties, when applicable, as well as national consumer protection regulations.

For any dispute regarding the interpretation, execution, validity, or effectiveness of these General Conditions and any contract concluded with the Buyer, the court of Bergamo will have jurisdiction, without prejudice to the provisions of the Consumer Code as indicated below.

If the Buyer qualifies as a Consumer within the meaning of art. 3 paragraph 1 lett. A of the Consumer Code, the competent jurisdiction for any dispute will be the place of residence or domicile of the consumer, if located in Italy.
